Terms of Service

1. Eligibility

You must be at least 13 years old (or 16 where local law sets a higher age) and capable of forming a binding contract to use the Services. If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. License grant (EULA)

Subject to your compliance with these Terms, Moose Welcome grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of each application on any device you own or control, solely for your personal, non-commercial use, in the manner permitted by the applicable app store's usage rules.

The Services are licensed, not sold to you. All rights not expressly granted are reserved by Moose Welcome and its licensors.

Restrictions

You may not, and may not permit anyone else to:

• Copy, modify, translate or create derivative works of the Services;
• Reverse engineer, decompile or disassemble any part of the Services, except to the extent applicable law expressly permits despite this limitation;
• Rent, lease, lend, sell, redistribute, sublicense or commercially exploit the Services;
• Remove, obscure or alter any proprietary notice;
• Circumvent or attempt to circumvent any security, entitlement, licensing or usage-limit mechanism;
• Use the Services to build a competing product, or to train a machine learning model on our output;
• Use the Services in any unlawful, infringing, harassing or abusive manner, or to generate content that violates the rights of others.

3. Accounts

Some features require an account. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity that occurs under your account. Notify us at support@moosewelcome.com promptly if you suspect unauthorised use. You may delete your account at any time — see our Account & Data Deletion page.

4. Subscriptions, free trials and billing

Certain features are offered on a paid subscription basis. All purchases are processed by Apple or Google through the app store account you used to download the application. We do not process your payment method directly and never receive your card details.

4.1 Auto-renewal

Subscriptions renew automatically at the price and interval disclosed at the point of purchase, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends. The subscription price and billing period are shown in the app before you confirm.

4.2 Free trials

Where we offer a free trial, it converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Free trials are limited to one per user per application unless stated otherwise.

4.3 Managing and cancelling

You can manage or cancel a subscription at any time in your app store account settings — on iOS via Settings > [your name] > Subscriptions, and on Android via Google Play > Profile > Payments & subscriptions > Subscriptions. Cancelling stops the next renewal; you keep access for the remainder of the period you have paid for. Deleting the app does not cancel a subscription. 4.4 Refunds

Because Apple and Google are the merchants of record, refunds are governed by their policies and must be requested through them. We cannot issue refunds for store purchases directly. We will nonetheless help where we can — contact us and we will do what the platform allows. Statutory withdrawal rights, including those available to consumers in the EEA and the UK, are unaffected by this section.

4.5 Price changes

We may change subscription prices. Changes apply only to future billing periods and take effect no earlier than the renewal following notice, which we will give in the app, by email, or through the app store as the platform requires. If you do not accept a price change, cancel before it takes effect.

5. Your content

You retain all ownership of the content you create, upload or submit through the Services ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce and transmit Your Content solely to operate and provide the Services to you — for example, to sync it between your devices or to pass it to the service providers listed in our Privacy Policy. This license ends when you delete Your Content or your account, save for backups pending routine deletion.

You are responsible for Your Content and represent that you have the rights necessary to submit it and that it does not infringe or violate the rights of any third party.

6. AI-generated output

Some of our applications generate text, images, audio or video using artificial intelligence. Such output is produced automatically, may be inaccurate, and should be reviewed before you rely on or share it. You are responsible for how you use it. We make no representation that AI output is unique — similar output may be generated for other users — and you must not use the Services to impersonate a real person or to create deceptive or unlawful material.

7. Intellectual property

The Services, including all software, designs, text, graphics, logos, and the Moose Welcome and application names and marks, are owned by Moose Welcome or its licensors and are protected by copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any such right to you.

If you send us feedback or suggestions, you grant us an unrestricted, perpetual, royalty-free right to use them without obligation or compensation to you.

8. Third-party services and app store terms

The Services may integrate or interoperate with third-party services, which are governed by their own terms. We are not responsible for third-party services.

Where you obtain an application from the Apple App Store, you acknowledge that these Terms are between you and Moose Welcome only, and not with Apple; that Apple has no obligation to furnish maintenance or support for the application; that Apple is not responsible for any product warranty or for addressing any claim relating to the application; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You further represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Where you obtain an application from Google Play, the Google Play Terms of Service additionally apply.

9. Availability and changes to the Services

We may modify, suspend or discontinue any part of the Services at any time. We aim for high availability but do not guarantee that the Services will be uninterrupted or error-free. Where we discontinue a paid Service entirely, we will give reasonable notice and, where required by law, a pro-rated refund for the unused portion of a prepaid term.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Services or other users. On termination the license granted in Section 2 ends immediately and you must stop using and delete all copies of the applications. Sections 5 through 14 survive termination.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT ACCESS WILL BE UNINTERRUPTED OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable statutory consumer right.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOOSE WELCOME AND ITS OFFICERS, MEMBERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

These limitations do not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Moose Welcome and its officers, members and employees from any claim, demand, loss or expense (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your infringement of any third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The courts located in Delaware will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer resident in the EEA or the UK, you retain the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We may update these Terms, and will revise the "Last updated" date and give notice of material changes before they take effect.
